Auto/18-Wheeler Accidents

Auto Accidents

Auto accidents happen across Texas every second of every day. Some involve minimal injuries while others involve larger or more catastrophic injuries, including death. Under Texas law, all drivers are required to have auto liability insurance. This means that the at-fault party needs to have insurance to pay you for those injuries and any property damage they caused.

Following an accident, however, many insurance companies attempt to deny coverage or liability for their insureds. They may deny based on an excluded driver, the owner of the policy did not give permission to the driver, underage driving, and the list goes on.  Knowing your rights and how to proceed against them ensures claims are not wrongfully and fraudulently denied, justice is served, and you receive a fair and justified monetary settlement.

At The Cantú Law Firm, we understand the difficulties caused by an auto accident. That is why our goal has always been to ensure that all your current and future needs are identified and addressed. Hardships can arise from the costs of medical treatment and rehabilitation, loss of wages from not being able to work, and the inability to attend family events and carry on with your normal way of life. Our attorneys and staff can guide you through this difficult time and will take a personal interest in your case to ensure you receive the compensation you deserve.  Call us now for a free attorney consultation at 210-547-0505.

18-Wheeler Accidents

Semi-truck accidents cause some of the most severe and catastrophic injuries in Texas.  Many truck drivers are found to be driving while distracted, failing to drive in a single lane, changing lanes when unsafe to do so, and failing to control their speed. All of these are major contributing factors given to truck drivers, year after year.  But why are there so many negligent truck drivers on the road?

With added pressure from their employers to meet deadlines, many truck drivers work long hours and can easily become distracted or fall asleep at the wheel.  Due to their size, it can be hard for truck drivers to stop on time when they need to.  Other companies don’t conduct proper background checks on new drivers.  Some don’t even offer any sort of safety training. Because of this, proving that the company had a disregard for the general public’s safety is vital to ensuring a successful outcome on many trucking accident injury cases. Knowing how to extract this information from the company is even more critical.

Due to the severe nature of these incidents semi-truck accidents are more complicated than your standard auto-to-auto rear-end accident. The first few days following an 18-wheeler accident are extremely crucial. Evidence that the company holds may be tampered with, records get lost, statements are forgotten, tire marks disappear, and the list goes on! Taking immediate action involves hiring mechanical engineers to conduct both site and vehicular inspections, preserve road markings, hire private investigators to interview potential witnesses, secure vital company evidence, and much more.

This is where we come in, and this is all we do.  We have successfully litigated hundreds of commercial cases throughout the years and recovered millions for injured victims.  Most settle after extensive litigation, but occasionally cases must be tried in front of a jury.  Having this experience matters.  It is important that you hire an attorney who not only knows how to correctly investigate, develop, and litigate your case, but also take the time to ensure you get the medical treatment you need now and in the future.

If you or a loved one has been injured by a semi-truck, don’t wait. Time will work against you.  Call The Cantú Law Firm at 210-547-0505.  All consultations with an attorney are free of charge, and we promise you will speak to an attorney!

Company Vehicle Accident

We understand that accidents happen, but when a company vehicle is involved, it is possible that not only the driver was at fault, but also the company. Examples of company negligence is negligent hiring and/or supervision of their drivers.  Oftentimes because the company has such high emphasis on cutting drive time, they don’t do the best job of hiring safe and careful drivers.

Since the vehicle is used to conduct company business a commercial insurance policy is required, and the company is liable for any injuries. Some examples of company vehicles include buses, vans, small company cars, delivery trucks, utility trucks, construction equipment, semi-trucks, and repair trucks. We have all seen them around, trucks or small cars wrapped in logos, small magnetic business signs, etc.  No matter what the company, if they are conducting business when the crash occurred the company should bear the responsibility for the injuries.

Knowing how to identify company vehicles is important. Knowing how to get hiring and employment records is even more important for a successful case.

Ride Share Accidents

Ride sharing, like Uber and Lyft, have become so commonplace in our world now that it is practically unlikely that someone has not used them at least once. Just like company tractors and trailers, rideshare companies are operating for a profit.  This means they can be held to a higher standard.

What happens if you are involved in an accident while in-route to your destination? Much depends on who is at fault.  Many times, ride share drivers are cautious, and most accidents are a result of another vehicle.  In this case, we must investigate the other party’s fault, and run through very similar fact-finding investigations.  There may be, however, a bigger policy that can compensate those injuries which warrant it.  Ride sharing companies will have insurance to cover this, if the injuries are present, and the proper work is conducted, victims may be adequately compensated.

But what happens when the rideshare driver is at fault? We have had similar cases.  One in particular, our clients were being transported to their home, when the rideshare-driver decided to make an illegal left turn resulting in our clients being t-boned on their side.  After it was determined that the rideshare driver was at fault, formal demands were made to the rideshare company and after litigation work, the case settled.

If you were injured while in a rideshare, call us. We can speak with you anytime of the day and give you our best advice on how to proceed.  Call now at 210-547-0505.
